Welcome to BeaBuddy, operated by Trofsof Group B.V. (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the BeaBuddy app (“App”). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Services Provided

BeaBuddy allows users to purchase and use tokens to generate personalized responses for dating conversations. Tokens can only be purchased through the Apple App Store and Google Play Store.

3. Account and Privacy

Device ID: We collect and store your device ID to facilitate payments. This information is not linked to any other data.
Email Address: If you contact us through the in-app contact form or via email, we may collect your email address solely to respond to your inquiry. We do not store your email address for any other purpose.

4. Purchases

  • All token purchases are processed through the Apple App Store and Google Play Store.
  • By purchasing tokens, you agree to comply with the terms and conditions of the respective platforms.
  • Tokens are non-refundable and cannot be exchanged for cash.
  • Trofsof Group B.V. is not responsible for any transaction issues arising from third-party platforms.

5. User Conduct

By using the App, you agree to:

  • Use the App in compliance with all applicable laws and regulations.
  • Not misuse the App for illegal, harmful, or inappropriate activities.
  • Respect the intellectual property rights of Trofsof Group B.V. and other users.

We reserve the right to terminate access to the App for users who violate these Terms.

6. User-Generated Contributions

The App may allow users to submit content, such as messages or other materials. By submitting content, you represent that:

  • You own or have the necessary rights to use the content.
  • Your contributions do not violate any laws or infringe on the rights of others.

7. Contribution License

By submitting content, you grant Trofsof Group B.V. a non-exclusive, royalty-free, worldwide license to use, display, and modify your contributions as necessary for the operation of the App.

8. Services Management

We reserve the right to:

  • Monitor the App for any violations of these Terms.
  • Suspend or terminate access to the App for users who violate the Terms.
  • Modify the App’s functionality or content at our discretion.

9. Term and Termination

These Terms remain in effect until terminated by either you or us. We may terminate your access to the App at any time for any reason without prior notice.

10. Modifications and Interruptions

We reserve the right to modify or discontinue the App at any time. We are not liable for any interruptions or errors affecting the App’s availability.

11. Governing Law

These Terms are governed by and interpreted under the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts in the Netherlands.

12. Dispute Resolution

In the event of a dispute, users agree to attempt to resolve the matter through informal negotiation with us before pursuing legal action.

We reserve the right to correct any errors, inaccuracies, or omissions in the App’s content or features.

The App is provided “as is” and “as available.” We do not guarantee the accuracy, functionality, or availability of the App.

15. Limitations of Liability

Trofsof Group B.V. is not liable for:

  • Indirect, incidental, or consequential damages arising from the use of the App.
  • Issues related to third-party platforms like the Apple App Store or Google Play Store.
  • Errors or interruptions in the functionality of the App.

16. Indemnification

You agree to indemnify and hold Trofsof Group B.V. harmless against any claims, damages, or losses resulting from your use of the App or violation of these Terms.

17. User Data

Although we store limited data (such as device IDs and email addresses for contact purposes), you acknowledge that any unauthorized access or breaches are at your own risk.

18. Electronic Communications, Transactions, and Signatures

By using the App, you consent to receive communications electronically and agree to the use of electronic signatures and records.

19. Content Suitable for All Audiences

The App’s content is designed to meet the standards for Content Suitable for All Audiences (CSAE). Harmful or inappropriate content is strictly prohibited. We reserve the right to remove any content that does not comply with these standards or terminate access to the App.

20. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be in full effect. These Terms constitute the entire agreement between you and Trofsof Group B.V.
